Context is everything, and it's society that makes the judgements.

What is society?  Is society the will of the majority acting with the coercive power of government or is society just sum of individuals making judgments for themselves?

My guess is that if it were legal for a restaurant to put up a whites only sign today, they would have very few customers.  Most people would be appalled and would dine elsewhere but would do it of their own volition, not because of a law.

As an Al Sharpton promo points out, slavery used to be acceptable...

The repulsive thing is that the government allowed slavery to happen.  Slavery is completely incompatible with liberty and should have never been allowed in the USA. Never. No person should have ever been allowed to own another person.

However, lets not confuse slavery with discrimination.  There is a world of difference between forcing one person to labor for another and allowing someone to decide not to associate with another because they are different.
