Indeed. John Roberts gets converted to liberalism. Who'd-a thunk it.

I'm not counting on that to be a permanent conversion, though. It's what psychiatrists call a "lucid moment". XD

Remember that Robert's was Bush's second choice.  Bush wanted Harriet Miers but the conservative base rallied hard against her nomination.  The base should be questioning the wisdom of that this morning.

The base has no wisdom, actually. They're the ones who thought that Dubya was a good idea for a second term, after all.  And we knew as soon as he was confirmed, John Roberts was an activist judge despite protestations to the contrary. He's now a liberal activist judge. Y'all got what you guys thought was a good idea for 8 years and his appointments. XD

He held that the mandate cannot be justified under either the commerce clause or the necessary and proper clause.

By the way, does this decision mean that performing an abortion may be subjected to a tax?

Not at all.  Doesn't the Court's rationale for upholding the individual mandate -- that Congress may tax failure to purchase health insurance -- mean that Congress could likewise tax abortion procedures?  I'm not advocating it, I'm just suggesting that if the taxing power is this broad, what would prevent its being applied to abortions?

Or what if Republicans took over the House, the Senate, and the White House at a future date, determined that is was good for all Americans to own guns for protection, couldn't they under this decision require everybody to purchase a gun or face a tax/fine?

Damn, we should've voted for Kerry like all you smart people did.
